General Terms and Conditions
Coffee Coaching Club GmbH
Gerberngasse 44 · 3011 Bern · UID CHE-298.907.551
As of: 22 October 2026
These Terms and Conditions govern the relationship between Coffee Coaching Club GmbH and its customers. Provisions that apply expressly only to consumers or only to business customers are marked accordingly; otherwise, they apply to both. Please read these Terms and Conditions carefully.
1. Scope, contracting party and definitions
1.1 These General Terms and Conditions (hereinafter «Terms and Conditions») govern the business relationship between Coffee Coaching Club GmbH, Gerberngasse 44, 3011 Bern, UID CHE-298.907.551 (hereinafter «CCC», «we» or «us») and its customers (hereinafter «customers» or «you») for all orders placed via the online shop at coffeecoachingclub.ch, in the shops, by email or on the basis of written quotations, as well as for service, maintenance and repair orders (clause 9a). Telephone orders are not accepted; no contract is concluded by telephone. Information provided by telephone is non-binding.
1.2 By placing an order or using our offers, customers accept these Terms and Conditions in full. Deviating or conflicting terms of customers do not apply, even if we do not expressly object to them.
1.3 A «consumer» is anyone who concludes a transaction for a purpose that cannot predominantly be attributed to their commercial or professional activity. A «business customer» is anyone who acts for commercial or professional purposes.
1.4 Our online shop is hosted on the Shopify platform; CCC’s contracting party is Shopify International Limited, Dublin, Ireland (see clause 15).
1.5 The German-language version of these Terms and Conditions is authoritative.
2. Conclusion of contract
2.1 The presentation of products in the online shop does not constitute a binding offer but a non-binding invitation to place an order.
2.2 By placing an order, customers submit a binding offer to purchase. The contract is only concluded when CCC accepts the order – by express written order confirmation (including by email), by issuing an invoice or by delivering the goods. An automatic acknowledgement of receipt from the online shop does not yet constitute acceptance.
2.3 CCC is entitled to reject an order in whole or in part without giving reasons, in particular in the event of lack of availability, obvious errors in price or product information or justified doubts about the customer’s ability to pay or the information provided by the customer.
2.4 Customers warrant that their details (in particular name, address, email, payment details) are true, complete and up to date, and keep them up to date.
3. Products, information and availability
3.1 All information on the goods (descriptions, images, colours, technical data) is non-binding and is partly based on information from the manufacturers; CCC accepts no liability for this. Deviations in colour and display due to the customer’s device are possible.
3.2 Changes in design and technology that improve functionality, as well as errors in description, illustration and price, are reserved. Product information is only updated on a random basis and without guarantee.
3.3 CCC may change products at any time, remove them from the range or limit the quantity supplied per person, region or order.
4. Prices
4.1 All prices are in Swiss francs (CHF), including statutory value added tax, but excluding shipping, packaging and any customs/import duties, unless expressly stated otherwise. Amounts incl. VAT in these Terms and Conditions are based on the standard rate of 8.1%; if the statutory rate changes, CCC will adjust them accordingly.
4.2 The price stated in the online shop at the time of the order is authoritative. Catalogue and online prices are guide prices and are continuously adjusted to the market; periodic price changes are reserved.
4.3 For promotions, their special conditions also apply and take precedence in the event of conflict.
5. Payment and retention of title
5.1 Payment is made using the payment methods offered during the ordering process (e.g. credit card, TWINT, prepayment, other methods displayed and cash payment in the shop). CCC may restrict the available payment methods in individual cases.
5.2 Acceptance of the order is subject to receipt or successful processing of the payment.
5.3 The goods delivered remain the property of CCC until paid in full (retention of title). If customers are in default of payment, CCC is entitled to withdraw from the contract and demand the return of the goods. CCC is entitled to have the retention of title entered in the competent register.
6. Delivery, shipping and transfer of risk
6.1 We deliver within Switzerland and the Principality of Liechtenstein. We do not deliver to other countries; only collection in Zürich by a courier engaged by the customer is possible (clause 6.6).
6.2 Within Switzerland and Liechtenstein, the flat-rate shipping charge is CHF 6.50 per order (incl. shipping, packaging, postage). Shipping costs are waived for orders with a value of CHF 60 or more.
6.3 Delivery times are non-binding estimates. CCC is not liable for delays caused by delivery services, customs clearance or events beyond its control. As a rule, items are ready for dispatch within two to four working days; otherwise, customers are notified of the expected delivery date. Partial deliveries are permitted; the aim is a single consolidated shipment, which is why an order may be held back until it is complete.
6.4 Upon handover of the goods to the delivery service, benefit and risk (in particular the risk of loss and damage) pass to the customer; this also applies to partial deliveries and free delivery. Delivery is at the customer’s expense and risk. Claims for externally visible transport damage are only settled against confirmation from the delivery service; visible damage must be reported immediately.
6.5 If customers are not present at the time of delivery and there are no special instructions, the goods may be left in front of the door of the flat or with neighbours in the same building. In the event of non-acceptance or automatic return, the full shipping costs are charged to the customer. Redelivery only takes place after payment of the renewed, full postage costs.
6.6 Special shipping conditions apply to appliances over 30 kg and to certain brands (e.g. Victoria Arduino); shipping is calculated separately at the current daily rate and is carried out by a service provider of our choice to the kerbside. For destinations outside Switzerland and Liechtenstein, only collection in Zürich is possible: the customer engages a courier of their choice to carry out the collection and bears all costs as well as export, customs, import and tax duties. In the case of returns (e.g. due to the customer’s failure to complete the import), shipping costs are not refunded.
7. Pre-orders and collection
7.1 Goods made available for collection must be collected within 7 days of the collection notification. If this is not done, CCC is entitled to deliver the goods on invoice, charging CHF 10 for postage. This clause 7.1 does not apply to appliances that customers have handed over to CCC for service, for repair or under a warranty claim; collection and uncollected appliances are governed by the Service Terms (clause 9a).
7.2 Ground coffee is invoiced in all cases if it is not collected or in the event of withdrawal.
8. No right of withdrawal/return; limited exchange
8.1 For contracts concluded in the online shop or by email, there is no statutory right of withdrawal or return under Swiss law. There is also no statutory right of return or exchange for purchases in the shop. CCC does not accept telephone orders (clause 1.1).
8.2 Business customers have no right of return, exchange or withdrawal. Orders are binding.
8.3 CCC voluntarily grants consumers a limited right of exchange, exclusively in accordance with this clause: within 7 days of receipt, only for unopened, unused goods in their original packaging and original condition and on presentation of the proof of purchase. The deadline is deemed to have been met if the written notification and the return are made within the deadline (date of posting). The return is made at the customer’s expense and risk to the address in accordance with clause 21.
8.4 No cash refund is made. An accepted exchange is settled exclusively by replacement delivery or by issuing a CCC voucher (shop credit). A restocking fee (handling effort) is deducted for every accepted return. It amounts to:
a) for goods with a value of up to and including CHF 200: 15% of the value of the goods;
b) for goods with a value of more than CHF 200: 3% of the value of the goods plus CHF 0.30 and plus a flat-rate charge for the shipping costs of the original delivery, based on the parcel weight of the outbound shipment (incl. packaging): up to 2 kg CHF 12.00; over 2 to 5 kg CHF 14.00; over 5 to 10 kg CHF 25.00; over 10 to 30 kg CHF 40.00; over 30 kg CHF 100.00. The fee under letter b amounts to a maximum of 15% of the value of the goods in total.
The fee is calculated per order; the total value of the items returned from one order is authoritative. The surcharge of CHF 0.30 is charged once per order. Refusal to accept or failure to collect a shipment does not constitute a request for exchange; clause 6.5 applies. Shipping and postage costs are not refunded.
8.5 The following in particular are excluded from exchange:
• electrical appliances;
• personalised products or products procured specifically for the customer;
• coffee (roasted or unroasted) and all foodstuffs as well as products with an expiry date;
• opened or used products and products that are no longer in their original condition (damaged, opened, with missing parts), unless CCC is responsible for this;
• reduced and promotional goods;
• gift and value vouchers as well as downloadable products;
• books, CDs, DVDs and software with signs of use.
• Spare and service parts (see clause 8.6).
8.6 Spare and service parts: The following applies to spare and service parts for machines and grinders (e.g. seals, shower screens, grinding burrs, valves, electronic and small parts):
a) They are procured on an order-specific basis and cannot be resold after installation or trial fitting on the appliance. Exchange, return and taking back are therefore excluded. This also applies if a part does not fit the customer’s machine.
b) The model, year of manufacture and serial number of the machine are authoritative for the fit. Customers check this information before ordering. If in doubt, we are happy to advise before the order is placed ([email protected]).
c) We recommend having spare parts fitted by a specialist. Clauses 9.5 and 13.3 apply to damage caused by improper installation.
d) The rights in the case of defective or faulty goods under clause 9 remain unaffected.
8.7 This clause 8 relates exclusively to the voluntary exchange of goods free of defects. The rights in the case of defective or faulty goods are governed exclusively by clause 9.
9. Rights in the event of defects, guarantee and repair
9.1 This clause 9 alone is authoritative for defective or faulty goods.
9.2 Statutory warranty periods from delivery of the goods (in the case of collection or purchase in the shop, from handover; proof by proof of purchase):
• for consumers: the statutory period for new goods, 12 months for used goods (second-hand items);
• for business customers and for appliances used in commercial, hospitality or office settings: 12 months; for spare and service parts (clause 8.6) for business customers: 6 months.
The statutory warranty is provided as a bring-in service and covers materials and labour at CCC. Customers bring the item to a shop or send it in, securely packaged for transport, after contacting us in advance (clauses 9.3 and 21). Shipping to CCC is at the customer’s expense and risk. If the complaint is justified, CCC bears the costs of returning the item to the customer at the standard rate of the shipping method designated by CCC within Switzerland and Liechtenstein; any additional costs of a different shipping method requested by the customer are borne by the customer. If the complaint is unfounded, clauses 9.7 and 9.8 apply. Clause 9.6 remains reserved.
9.3 Procedure in the event of a defect/warranty claim: Customers report the defect within the statutory warranty period with the proof of purchase or order number and a description of the fault – most easily via the warranty form on coffeecoachingclub.ch, by email to [email protected] or in a shop. They bring the item to a shop in Bern or Zürich (clause 21) or send it in after CCC has provided them with shipping instructions. The deadline is met if the report is received within the statutory warranty period and the item is handed over within 30 days of CCC’s response. In the event of a warranty claim or defect, the item is primarily repaired (remedy by repair); repair is always the preferred form of restoration. If repair is not possible or is economically disproportionate, CCC replaces the item with an equivalent one.
9.4 Exclusion of cash refunds: There is no entitlement to rescind the purchase against repayment of the purchase price (rescission) or to have the purchase price reduced (price reduction); no cash payment is made. If neither repair nor equivalent replacement is possible (e.g. because the item is no longer stocked or manufactured or a repair is not possible), CCC issues a CCC voucher (shop credit) for the current value of the item.
The current value corresponds to the current new price of the item at CCC (if the item is no longer stocked: the price of an equivalent successor model or the last valid CCC selling price), less linear depreciation for the period of use since delivery, measured against the usual service life of the respective product category based on recognised service life tables. Within the first year after delivery, the current value amounts to at least 75%, and in the second year to at least 50%, of the purchase price paid.
9.5 The statutory warranty and the guarantee cover material and manufacturing defects that were already present at the time of delivery. Excluded are damage and defects that only arise afterwards through use or external influences, in particular as a result of:
• improper handling or operating errors (e.g. foreign objects in the grinding mechanism);
• limescale, soiling and lack of or inadequate cleaning and maintenance (e.g. failure to descale);
• natural wear, in particular the normal, use-related wear and tear of wear parts;
• damage caused by falls, impacts, moisture or natural hazards and other external influences for which CCC is not responsible;
• the use of unsuitable or incompatible accessories, spare parts or cleaning agents.
Wear parts include in particular: seals and O-rings (e.g. brew group seals), shower screens, screens and filter baskets, flat burrs and conical burrs, valves and hoses, water filters and filter cartridges, batteries, rechargeable batteries and lamps, as well as small plastic parts subject to permanent mechanical stress (e.g. hinges, catches, dosing flaps). The exclusion covers the normal, use-related wear and tear of these parts; their premature failure as a result of a material or manufacturing defect remains covered by the statutory warranty and the guarantee.
The guarantee lapses if changes or repairs are made to the goods without CCC’s written consent. The mandatory statutory rights in respect of defects (clause 9.9) remain reserved in all cases.
9.6 Manufacturer’s guarantees: Where manufacturers grant their own (voluntary) guarantees, their conditions apply in addition to and independently of the statutory rights in respect of defects. For appliances from Weber Workshops, the manufacturer’s guarantee is 12 months. If an appliance is shipped to Weber Workshops for repair within the guarantee period, Weber Workshops bears the shipping costs. If it is established that the damage was caused by incorrect operation, the customer is invoiced for the full costs of shipping and repair, including materials.
9.7 Inspection and handling fee for unjustified complaints: If an appliance is sent in for repair or on the basis of an alleged defect and the inspection shows that there is no defect covered by the statutory warranty – i.e. no fault can be identified or the appliance works perfectly – CCC invoices the inspection and handling effort. The hourly rate is CHF 189.20 incl. VAT (CHF 175.00 excl. VAT); a minimum of CHF 54.05 incl. VAT (CHF 50.00 excl. VAT) is charged. The costs of the return shipment are added. If the expected effort significantly exceeds the minimum amount, CCC informs the customer before carrying out any further chargeable work. If the rejection is based on one of the grounds set out in clause 9.8, clause 9.8 applies.
9.8 Rejection of the guarantee due to incorrect operation, damage, limescale, lack of maintenance or wear: If a guarantee or statutory warranty claim is rejected because the defect or damage is attributable to incorrect operation, improper handling, damage to the item, limescale, soiling, lack of or inadequate cleaning or maintenance, or the normal wear and tear of wear parts (clause 9.5), CCC invoices a flat-rate expense allowance of CHF 86.50 plus handling and shipping costs of CHF 27.00, together CHF 113.50 incl. VAT (CHF 105.00 excl. VAT). Deviating provisions of the manufacturer’s guarantee (clause 9.6) remain reserved.
9.9 Mandatory statutory rights remain reserved: For consumers, the mandatory statutory minimum periods of the statutory warranty are not undercut; to this extent, the mandatory statutory provisions take precedence over these Terms and Conditions. Liability for fraudulently concealed defects also remains unaffected.
9a. Service and repair orders
9a.1 Service, maintenance and repair orders for customers’ appliances are subject to CCC’s Service Terms in the version valid at the time the order is placed. They are published with version and date at coffeecoachingclub.ch/en/pages/servicebedingungen and are handed over together with the service order on acceptance. In the event of any conflict, the Service Terms take precedence over these Terms and Conditions.
9a.2 If the customer bought the item from CCC, the rights in respect of defects are governed by clause 9; the Service Terms apply to the acceptance, processing and return of the appliance.
9a.3 Approvals, refusals and changes to service and repair orders, in particular the approval of a cost estimate, must be made in writing; an email is sufficient. Oral and telephone declarations are not binding.
10. Cancellation and modification of orders
10.1 Orders are binding and oblige customers to accept the products and services.
10.2 CCC may accept subsequent changes or cancellations at its sole discretion. Cancellations are possible at the latest until the goods are dispatched; after dispatch, only the provisions on returns (clause 8) apply. In the event of an accepted cancellation before dispatch, CCC is entitled to charge a flat-rate handling fee of 3% of the cancelled order value plus CHF 0.30; for goods procured specifically for the customer or customer-specific goods, additionally any loss in value since the order.
10.3 The flat-rate handling fee under clause 10.2 is based on the fees of payment service providers (e.g. for payment by credit card or TWINT) that are charged to CCC for payment processing and are not refunded; it is therefore non-refundable.
10.4 Reversals are not made in cash but – to the extent that any refund is made at all – at CCC’s discretion by offsetting or by CCC voucher.
10.5 If (partial) delivery becomes impossible after the conclusion of the contract, customers are informed immediately. Payments already made for the part that cannot be delivered are refunded, or customers are released from the corresponding payment obligation. Further claims due to delayed or failed delivery are excluded.
10a. Subscriptions
10a.1 Selected coffees can be ordered as a subscription in the online shop. To do so, customers select a delivery frequency on the product page (e.g. every 2 weeks or every month) instead of a one-off purchase. The Cancellation Policy (subscription terms) published in the online shop also applies; in the event of any conflict, these Terms and Conditions take precedence.
10a.2 The subscription is concluded for an indefinite period and renews automatically from delivery to delivery until it ends or is cancelled. At checkout, customers expressly confirm that the recurring amount will be charged automatically. Each delivery is triggered as a separate order; these Terms and Conditions apply to it.
10a.3 Notwithstanding clause 4.2, for each delivery the price displayed at checkout before conclusion plus shipping costs is charged automatically to the payment method stored at conclusion. Only the payment methods offered for this purpose at checkout are available for subscriptions. If CCC changes the price of an ongoing subscription, CCC notifies customers of this by email in advance, at least 14 days before the first charge at the new price; customers may cancel the subscription until then. The same applies to changes to these Terms and Conditions that affect ongoing subscriptions.
10a.4 In the subscription management area of their customer account, customers can skip individual deliveries, resume a paused subscription and change the payment method and delivery address. They can cancel the subscription at any time free of charge, in the subscription management area or by email to [email protected]. After receipt of the cancellation, no further charges are made; deliveries already charged are still delivered. CCC refunds charges for deliveries that are not delivered to the original payment method; clause 10.4 does not apply in this respect.
10a.5 If a charge fails, it is retried up to three more times at intervals of 7 days; if it remains unsuccessful, the subscription ends. If a coffee is out of stock, the charge and delivery are retried up to ten times at intervals of one day and then skipped; the subscription continues. CCC may end a subscription with effect for future deliveries, in particular if a coffee is no longer offered; customers are informed of this in advance.
10a.6 Clauses 8 and 9 apply to every delivery. Coffee is excluded from exchange (clause 8.5).
11. Courses, workshops and events
11.1 Registrations for courses, workshops and events are binding.
11.2 Rebooking or cancellation free of charge is possible up to 14 days before the start of the course (in writing or orally). Thereafter, the following applies:
• cancellation less than 14 days before the start of the course: 50% of the total course fees;
• cancellation less than 3 days before the start of the course: 100% of the total course fees;
• non-attendance (no-show): 100% of the total course fees.
Rebooking to a substitute participant is possible up to 3 days before the course.
11.3 If a course cannot be held for reasons of force majeure (e.g. accident or illness of the course instructor, official orders, pandemic), customers are informed immediately and a make-up date is arranged. The course is only guaranteed to take place if there is a sufficient number of participants; otherwise, an alternative date is sought.
11.4 There are no cash refunds for courses. Course vouchers or course bookings can only be converted into another value voucher (e.g. shop/online shop voucher); the course voucher must be sent to CCC for this purpose.
11.5 When a new coffee machine with a purchase price of CHF 1,500 or more is purchased, a private barista introductory course of around 60 minutes is included (in Bern, Zürich or online). The following applies to this included course:
a) It applies to a maximum of two people from the same household or the same company who attend the course together on the same date. It cannot be split across several dates or among people from different households or companies.
b) The course must take place within one month of delivery or collection of the machine. If it is not taken within this period, the entitlement lapses without replacement.
12. Artificial intelligence (AI), interactive tools and recommendations
12.1 CCC provides interactive tools, simulators, configurators as well as advisory and recommendation functions that are based wholly or partly on algorithms or artificial intelligence. They serve exclusively for non-binding information and illustration, are based on simplified models, assumptions and manufacturer/third-party information and do not constitute any assurance of characteristics, professional advice or legally binding information.
12.2 CCC accepts no liability for the accuracy, completeness, timeliness or suitability of the results and recommendations generated by such tools. Use is at the user’s own risk; customers must check the results on their own responsibility before making a purchase or application decision. Only the product description and the order confirmation are authoritative.
12.3 Chat assistant «Jackson»: In the chat window on coffeecoachingclub.ch, «Jackson», an AI assistant based on Shopify Inbox, responds first. His answers are generated automatically, may be incorrect or incomplete and are non-binding. No contract is concluded via the chat. Jackson cannot accept or change orders or jobs and cannot make any commitments on behalf of CCC regarding prices, delivery dates, guarantees, goodwill or other matters. Only orders under clause 2 and express written confirmations from CCC are binding. Customers can request at any time that a person from CCC takes over: in the chat, by email to [email protected], by telephone or in the shops.
12.4 Input: Customers do not enter any payment details, passwords, health data or other sensitive personal data, nor any personal data of third parties, in the chat or in other AI functions. Input is processed in accordance with the Privacy Policy; according to its own information, the chat provider may also use it to improve its AI assistant.
12.5 AI at CCC: CCC uses AI tools from third-party providers as aids, in particular to prepare replies to customers, to record service and repair orders and to create texts (providers: see Privacy Policy). Messages that CCC prepares with them are always checked and sent by a CCC employee; they are not sent automatically.
12.6 No automated individual decisions: CCC does not make any decisions that are based exclusively on automated processing and that have legal consequences for customers or significantly affect them (Art. 21 FADP), in particular not regarding guarantee, goodwill or service claims; AI tools at most prepare such decisions. The automated fraud screening of orders in accordance with the Privacy Policy remains reserved; if it rejects an order solely by automated means, customers can state their point of view and request that a person reviews the decision.
12.7 AI-assisted content: Texts, images and descriptions in the online shop may have been created or edited with the support of AI. The same rules apply to them as to all other content, in particular clauses 2.1, 2.3, 3.1 and 3.2.
12.8 No liability for AI results: Answers, results and recommendations from AI functions, in particular from the chat assistant, tools, simulators and configurators, are generated automatically and may be incorrect, incomplete or outdated. They are non-binding and do not constitute any assurance of characteristics, guarantee, advisory contract or agreement on the quality of a product or service. Customers check them themselves before any purchase, application or operating decision, in particular on the basis of the product description, the manufacturer’s operating instructions and CCC’s confirmation. To the extent permitted by law, any liability of CCC for damage arising from the use of such results or from reliance on them is excluded, in particular for slight negligence and for errors of the AI systems used and their providers. Clause 13.4 remains reserved.
13. Liability
13.1 To the extent permitted by law, CCC’s liability – on whatever legal grounds – is excluded, in particular for slight negligence and for indirect damage, consequential damage, consequential damage caused by defects, loss of profit, loss of data or production and damage not incurred on the delivered item itself. This clause 13.1 does not apply to damage to customers’ appliances that are in CCC’s custody for service, for repair or under a warranty claim; the liability rules of the Service Terms (clause 9a; Service Terms clause 10) apply to these.
13.2 All claims of customers arising from breach of contract are conclusively governed by these Terms and Conditions. Claims not expressly mentioned, in particular for damages, price reduction, rescission or withdrawal, are excluded to the extent permitted by law.
13.3 CCC is not liable for damage resulting from improper use, natural wear and tear or failure to carry out maintenance.
13.4 Excluded from these limitations and unaffected in all cases is liability for intent and gross negligence, for personal injury (death, bodily injury or damage to health), liability under the Product Liability Act and other mandatory statutory liability.
13.5 To the extent that CCC’s liability is excluded or limited, this also applies, to the extent permitted by law, to the personal liability of CCC’s governing bodies, employees and auxiliary persons.
14. Intellectual property
14.1 All CCC content (trademarks, logos, texts, images, graphics, videos, tool and simulator content and their selection and arrangement) is the property of CCC or its licensors and is protected by copyright and trademark law.
14.2 Use is only permitted for personal, non-commercial purposes and for placing an order. Any further use – in particular reproduction, distribution, editing, public performance or storage – requires CCC’s prior written consent.
14.3 Third-party trademarks, product names and logos are the property of their respective owners.
14.4 If customers submit content (e.g. feedback, reviews, suggestions), they grant CCC a free, unlimited in time and territory, transferable and sublicensable right to use, edit and exploit this content. Customers warrant that they hold the necessary rights and do not infringe any third-party rights. CCC is not obliged to treat such content confidentially or to remunerate it.
15. Platform (Shopify) and third-party providers
15.1 The online shop is operated via the Shopify platform (CCC’s contracting party: Shopify International Limited, Dublin, Ireland). All purchases are concluded exclusively between customers and CCC. Shopify is not a contracting party and is not liable for transactions between customers and CCC.
15.2 The services may contain third-party tools, content and links that CCC does not control. Their use is «as is» and at the user’s own risk; the terms of the respective third-party providers apply. CCC is not liable for third-party content, products or services.
16. Data protection and data use
16.1 The processing of personal data is governed by the Federal Act on Data Protection (FADP) and CCC’s Privacy Policy (coffeecoachingclub.ch/en/pages/datenschutzerklaerung). This clause 16 summarises the most important points; the Privacy Policy is authoritative.
16.2 For orders, subscriptions, courses and customer service, CCC processes in particular name, delivery and billing address, email address, telephone number, order, payment and shipping details and communication with customers in order to conclude and perform contracts, to process returns and warranty claims and to fulfil legal obligations such as bookkeeping.
16.3 For service, repair and warranty orders, CCC additionally processes information about the appliance (brand, model, serial number, age, fault description), photos and videos, the condition report, the signature on the service order and the order data (cost cap, cost estimate, approvals, work carried out). Depending on the appliance, a partner workshop, the general importer or the manufacturer receives the information required to carry out the work or to process the guarantee; manufacturers may be based abroad.
16.4 Payment service providers (e.g. Shopify Payments, TWINT, Klarna, HeyLight) and shipping service providers (e.g. Swiss Post, DHL Express) receive the data they need for payment or delivery; some payment service providers also process it under their own responsibility. The online shop runs on Shopify (clause 15).
16.5 CCC uses other service providers, including abroad, among them AI services (clause 12). Which service providers, in which countries and on what basis is set out in the Privacy Policy.
17. Permitted use
17.1 The services may only be used for lawful purposes. Prohibited in particular are unlawful or abusive use, the infringement of third-party rights, the transmission of false information or malware, the sending of unsolicited advertising (spam), the unauthorised collection of third-party data as well as phishing, spidering, crawling or scraping activities and the circumvention of security features.
17.2 Automated extraction and AI training: Without CCC’s prior written consent, it is prohibited to extract, copy or store content of the services – in particular texts, images, product and price data, reviews and outputs of tools and chat – using robots, crawlers, scrapers or similar automated means, to use it for databases, shop copies or competing offerings or to use it for training, fine-tuning or evaluating AI or machine learning models. Access by search engines and AI services is permitted to the extent that CCC allows in the robots.txt of coffeecoachingclub.ch; CCC may change this permission at any time. CCC’s further rights, in particular under copyright, trademark and unfair competition law (e.g. Art. 5(c) of the Federal Act against Unfair Competition, UCA), remain reserved.
17.3 In the event of a violation, CCC is entitled to block, restrict or close accounts and access at any time and without prior notice. Claims accrued until termination remain owed.
18. Final provisions
18.1 Should individual provisions of these Terms and Conditions be or become invalid in whole or in part, the validity of the remaining provisions remains unaffected. The invalid provision is replaced by the permissible provision that comes closest to its economic purpose.
18.2 Failure to exercise a right under these Terms and Conditions does not constitute a waiver.
18.3 Customers may not transfer rights and obligations under the contract without CCC’s prior written consent. CCC is entitled to transfer the contract and the rights and obligations arising from it to third parties.
18.4 These Terms and Conditions and the policies published in the shop constitute the entire agreement and replace earlier versions. The Terms and Conditions valid at the time the contract is concluded apply. CCC reserves the right to change these Terms and Conditions at any time; the version published at the time of the order is authoritative.
19. Applicable law and place of jurisdiction
19.1 Swiss law applies exclusively, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG) and of the conflict-of-law rules.
19.2 The exclusive place of jurisdiction is – to the extent permitted by law – CCC’s registered office in Bern, Switzerland. Mandatory places of jurisdiction, in particular in favour of consumers, remain reserved.
